An arrest without probable cause is a seizure the Constitution forbids.

The Fourth Amendment protects you from 'unreasonable seizures,' and an arrest is one of the most serious seizures the government can carry out. To arrest you lawfully, police generally need probable cause — facts that would lead a reasonable officer to believe you committed a crime. When officers arrest someone without probable cause, rely on a warrant they obtained through false statements, or hold someone after it is clear they have the wrong person, it can be a false arrest or false imprisonment.

These claims often arise from mistaken identity, arrests based on fabricated or recklessly false police reports, retaliatory arrests meant to punish someone for talking back or recording the police, and detentions that continue long after any justification has evaporated. Malicious prosecution is a related claim that applies when officers push forward with criminal charges they know are baseless and the case later ends in the accused person's favor.

Like other police misconduct, false arrest is typically litigated under 42 U.S.C. § 1983, and in Colorado may also be brought under the state civil rights act, C.R.S. § 13-21-131. A charge that was dropped, dismissed, or ended in acquittal is often an important part of the story — but you do not always have to win the criminal case to have a civil claim.
