Kosloski Law Files Civil Rights Lawsuit Against Lafayette Police Officer Who Assaulted Woman on Her Way to Work

Yesterday, Kosloski Law, on behalf of Jazzminn Martell, filed a civil rights lawsuit against Lafayette police officer Nathan Cashion, alleging that Officer Cashion assaulted Ms. Martell in a parking lot as she was on her way to work. The lawsuit, filed in Adams County District Court under case number 24CV31908, alleges multiple claims including violation of Ms. Martell’s rights under the Colorado Constitution, false imprisonment, assault, and battery.

The complaint states that on November 20, 2024, at approximately 8:00 a.m., Officer Cashion aggressively tailgated Ms. Martell and followed her into a parking lot in Thornton, Colorado. The lawsuit alleges that Officer Cashion was not driving a marked police vehicle, was not in uniform, and did not identify himself as a police officer. When Ms. Martell exited her vehicle and told him to stop following her, Officer Cashion allegedly responded by grabbing her arm, twisting it behind her back, and forcefully slamming her face-first into her car—without any lawful justification. According to the complaint, when later asked about his actions, Officer Cashion’s only explanation was that his “training kicked in.”

Jazzmin Martell spoke out regarding the filing of the lawsuit stating “Officer Cashion’s assault left me physically injured and emotionally devastated. It’s difficult to put into words what it feels like to have your personal space violated like this. This assault has affected nearly every part of my life—from my work to my personal relationships. I want to send a clear message that being a police officer—on or off duty—does not give anyone the right to intimidate, harm, or violate another person’s rights.”

“This was not policing—it was harassment and needless violence by someone who happened to be a police officer,” said Ms. Martell’s attorney, Jason Kosloski. “Ms. Martell was simply trying to go to work and ended up being attacked by someone who swore an oath to protect her. That’s not okay, and it can’t go unchecked. We’re here to hold him accountable and to try and make sure he’s not able to hurt anyone else.”

The lawsuit is brought under Colorado’s Enhancing Law Enforcement Integrity Act, a landmark law enacted in 2020 that eliminated qualified immunity for police officers accused of violating state constitutional rights. This act ensures that victims of police misconduct have a clear avenue to seek justice and hold law enforcement accountable for their actions.
